Insured Claims

Insurance companies have a responsibility to look out for their bottom line that trumps their responsibility to ensure you receive all the compensation you need. Consequently, an insurance company often wants to settle your claim for less than you deserve. Uninsured or Underinsured Claims

If you are struck by a motor vehicle driven by an uninsured driver, we can make a claim on your behalf for benefits under your uninsured/underinsured motorist coverage.  This coverage protects you and your family when you are struck by a person who failed to purchase the minimum auto insurance coverage required by law. If a negligent driver causes you harm but does not have sufficient insurance coverage to pay for all your losses, we can also protect you by filing a claim under your underinsured motorist or “UM” coverage.

Here is an example of uninsured/underinsured motorist coverage in action:  Suppose you collide with a negligent driver and suffer serious injury.  The driver who caused the accident carries auto insurance that will pay up to $20,000  for liability claims – but you needed $100,000 in medical care for the injuries you suffered in the crash. Meanwhile, your own auto insurance includes up to $300,000 per person in coverage for an uninsured/underinsured motorist accident. Obviously, in this situation the negligent driver’s insurance policy was not sufficient to address the serious injuries, and losses, you sustained in the accident.

Under Connecticut law, you may receive coverage up to the limits of your UM coverage minus the limits  paid by the  negligent driver’s liability coverage.  In this example, your UM coverage limit is $280,000, or the $300,000 total minus the negligent driver’s $20,000 in coverage.   Many people do not realize that their own insurance policy can provide  “UM” coverage in situations such as this – where the negligent driver’s coverage is limited or non-existent [for illegally operated vehicles being driven with no insurance].   The experienced attorneys at Kocian Law Group can ensure you  receive the full benefits of your UM coverage.
